TERMS AND CONDITIONS OF THE A1MATE ONLINE STORE
Effective from: 09.08.2026
1. Definitions
- Seller – Vacgear Sp. z o.o., with its registered office at ul. Ostrobramska 101 lok. 301, 04-041 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register under KRS No. 0000975914, NIP 1133061099, REGON 522241389.
- Store – the A1MATE online store operated by the Seller at a1mate.com.
- Customer – a natural person, legal person or organisational unit purchasing Goods through the Store.
- Consumer – a natural person entering into a transaction with the Seller for purposes which are not directly related to that person's trade, business or professional activity.
- Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person under applicable Polish law.
- Goods – movable goods offered for sale in the Store, in particular reusable dust collection bags and accessories for professional vacuum cleaners.
- Terms and Conditions – these Terms and Conditions of the A1MATE online store.

3. Technical Requirements

To use the Store correctly, the Customer requires:
a. a device with Internet access;
b. an up-to-date web browser;
c. an active email address when placing an order or creating an account. - The Store may require JavaScript and cookies to function correctly.
- Customers must use the Store in accordance with applicable law and good practice and must not provide unlawful content.
4. Placing Orders
- Information about Goods displayed in the Store constitutes an invitation to enter into a contract and does not constitute a binding offer within the meaning of the Polish Civil Code.

To place an order, the Customer:
a. selects the Goods;
b. adds the Goods to the shopping cart;
c. provides the information required to process the order;
d. selects an available delivery method and payment method;
e. accepts these Terms and Conditions;
f. confirms the order using a button clearly indicating the obligation to pay. - Before submitting the order, the Customer may review and correct the information entered.
- After an order has been submitted, the Customer receives confirmation by email.
- The sales contract is concluded when the Seller accepts the order for processing and sends confirmation to the Customer.
- The contract may be concluded in any language version made available by the Store.
5. Prices and Payment
- Prices displayed in the Store are gross prices and include applicable taxes unless expressly stated otherwise.
- Any delivery charges are shown to the Customer before the order is submitted.
- Available payment methods are displayed during checkout.
- Electronic payments may be processed by external payment service providers.
- The Customer must make payment using the selected payment method and within the time indicated during checkout.
- The Seller issues sales and tax documents in accordance with applicable law.
- Where a Customer provides valid business and VAT information, the tax treatment of the transaction will be determined in accordance with applicable tax regulations.
6. Delivery
- The Seller delivers Goods to the countries and using the delivery methods available during checkout.
- Information about the expected dispatch or delivery time is displayed in the Store.
- Unless otherwise stated, the processing period begins after payment has been successfully received.
- The Customer is responsible for providing a complete and correct delivery address.
- The Seller is not responsible for delays resulting from incorrect or incomplete delivery information provided by the Customer.
- For deliveries outside the European Union, customs duties, import VAT or other charges imposed by the country of destination may apply unless they are expressly included in the price or delivery option offered by the Store.
- For Consumer purchases, responsibility for accidental loss or damage to Goods during delivery remains with the Seller until the Consumer receives the Goods, except where the Consumer independently selected a carrier not offered by the Seller.
7. Consumer Right of Withdrawal
- A Consumer and an Entrepreneur with consumer rights may withdraw from a distance contract within 14 days without giving any reason. For a standard online purchase of Goods, the withdrawal period generally begins when the Consumer receives the Goods.
- To exercise the right of withdrawal, the Customer must inform the Seller by an unequivocal statement, for example by email to:
or by post to the Seller's address.
- The Customer may use the model withdrawal form attached to these Terms and Conditions, but use of the form is not mandatory.
- It is sufficient for the Customer to send the withdrawal notice before the 14-day period expires.
- After withdrawing from the contract, the Customer must return the Goods without undue delay and no later than 14 days after informing the Seller of the withdrawal.

- The Customer bears the direct cost of returning the Goods unless otherwise agreed or required by applicable law.
- The Seller will refund payments received from the Consumer which are subject to reimbursement, including the original delivery charge up to the cost of the least expensive standard delivery method offered by the Seller.
- The refund will be made no later than 14 days after the Seller is informed of the Consumer's decision to withdraw.
- The Seller may withhold reimbursement until the Goods have been received or until the Customer provides evidence that the Goods have been sent back, whichever occurs first.
- Unless otherwise agreed, the refund will be made using the same payment method used for the original transaction.
- The Consumer is responsible for any reduction in the value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
8. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply where excluded by applicable law, including, where relevant, contracts concerning:
- Goods made to the Customer's specifications or clearly personalised;
- Goods which, after delivery and due to their nature, become inseparably mixed or connected with other items;
- sealed Goods which are not suitable for return due to health protection or hygiene reasons where the seal has been broken after delivery, where the statutory conditions for such exclusion are satisfied.
Statutory exclusions from the right of withdrawal are limited and should only be applied where the legal requirements for the particular exclusion are actually met.
9. Conformity of Goods and Consumer Complaints
- The Seller is responsible for supplying Goods that conform to the sales contract.
- Goods should conform, in particular, as regards their description, type, quantity, quality, functionality and other characteristics agreed with the Customer.
- If Goods do not conform to the contract, the Consumer may exercise the remedies available under applicable consumer law.

In accordance with Polish consumer law, the Consumer may generally request that the Goods be brought into conformity by:
a. repair; or
b. replacement. -
Where the conditions provided by law are satisfied, the Consumer may also be entitled to:
a. a reduction of the price; or
b. termination of the contract and reimbursement.
These remedies reflect the current Polish consumer-law framework for Goods that do not conform to the contract.
- Complaints may be submitted by email to:

To facilitate processing, a complaint should, where possible, include:
a. the Customer's name and contact details;
b. the order number;
c. a description of the problem;
d. the remedy requested by the Customer.
Failure to provide any of the above does not deprive a Consumer of statutory complaint rights.
- If examination of the Goods is necessary, the Seller will inform the Customer how the Goods should be provided or returned.
- Costs of bringing Goods into conformity with the contract are borne by the Seller where required by applicable law.
- The Seller will respond to a Consumer complaint within 14 days of receiving it, in accordance with applicable Polish consumer law.
- Any voluntary commercial warranty, if provided for particular Goods, is additional to and does not limit the Consumer's statutory rights.
10. Compatibility and Product Information
- A1MATE reusable dust bags are replacement accessories intended for use with the vacuum cleaner models identified in the relevant product description.
- The Customer should verify the vacuum cleaner model and product compatibility before placing an order.
- References to manufacturers and vacuum cleaner brands such as Festool, Bosch, Makita, DeWALT, Metabo, HiKOKI/Hitachi, FLEX, Stihl and other third-party brands are used solely to identify product compatibility unless expressly stated otherwise.
- A1MATE products are manufactured by Vacgear Sp. z o.o. and are not represented as original products manufactured by the referenced vacuum cleaner manufacturers unless expressly indicated.
- Product photographs, dimensions and compatibility information are intended to enable the Customer to identify the correct product. Minor visual differences that do not affect functionality may occur as a result of production changes.
11. Use of the Goods
- Goods must be used in accordance with their intended purpose and any instructions or safety information supplied with the product.
- The reusable dust bags sold by A1MATE are intended for compatible vacuum cleaners specified in the product description.
- The Customer should empty and maintain reusable dust bags appropriately to avoid excessive loading or damage.
- Unless a particular product is expressly described as suitable for such use, Goods should not be used for materials or applications for which they have not been designed.
12. Sales to Business Customers
- The provisions of this section apply to Customers purchasing in connection with their business or professional activity who do not qualify as Entrepreneurs with consumer rights.
- To the extent permitted by law, the Seller's statutory warranty liability under the Polish Civil Code may be excluded in relation to such business Customers.
- To the extent permitted by applicable law, the Seller is not liable to business Customers for indirect loss or loss of profit.
- To the extent permitted by law, the Seller's total liability to a business Customer relating to an order is limited to the value of the order giving rise to the claim.
- Where legally permissible, disputes between the Seller and a business Customer will be submitted to the court having jurisdiction over the Seller's registered office.
13. Customer Account
- Creating a Customer Account is voluntary and free of charge.

An Account may enable the Customer to:
a. review order history;
b. check order status;
c. save information for future purchases. - The Account service is provided for an indefinite period.
- The Customer may request deletion of the Account at any time without charge.
- Requests concerning an Account may be sent to:
14. Newsletter
- Subscription to the Newsletter is voluntary.
- The Newsletter may contain information concerning A1MATE products, new products, availability, promotions and other commercial information.
- The Newsletter service is provided free of charge for an indefinite period.

Subscribers may unsubscribe at any time by:
a. using the unsubscribe function contained in an email; or
b. contacting support@a1mate.com.
15. Personal Data and Cookies
- The controller of Customers' personal data is:

- Personal data is processed in accordance with applicable data protection laws, including the GDPR where applicable.
- Detailed information on the purposes and legal bases of processing, retention periods and data-subject rights is provided in the Store's Privacy Policy.
- The Store uses cookies and similar technologies in accordance with the Privacy Policy and the Store's cookie settings.
16. Alternative Dispute Resolution
- Consumers may use out-of-court complaint and dispute-resolution procedures available under applicable consumer law.
- Information about consumer assistance and authorised alternative dispute-resolution bodies in Poland is available through the Polish Office of Competition and Consumer Protection (UOKiK) and other competent consumer authorities.
- Consumers residing in other European countries may also obtain information from the competent consumer-protection and ADR bodies in their country.
- The former European Commission Online Dispute Resolution (ODR) Platform is not referenced in these Terms because it was discontinued on 20 July 2025.
17. Governing Law
- These Terms and Conditions and contracts concluded through the Store are governed by Polish law, subject to applicable mandatory consumer-protection rules.
- Where the Customer is a Consumer residing in another country, the choice of Polish law does not deprive the Consumer of protection afforded by mandatory provisions of the law that would apply to that Consumer where such protection cannot legally be excluded by contract. This principle is reflected for EU consumer contracts in Article 6 of the Rome I Regulation.
- Nothing in these Terms and Conditions excludes or restricts any mandatory statutory rights granted to Consumers.
18. Amendments to these Terms and Conditions

The Seller may amend these Terms and Conditions for justified reasons, including:
a. changes in applicable law;
b. changes in payment or delivery methods;
c. changes in Store functionality;
d. changes in the Seller's details or methods of contact. - Amendments do not affect orders placed before the amended Terms and Conditions enter into force.
- Where an amendment affects an ongoing service such as a Customer Account or Newsletter, users will be informed as required by applicable law.
19. Final Provisions
- These Terms and Conditions are made available free of charge in a form enabling Customers to save and reproduce them.
- If any provision of these Terms and Conditions is invalid or unenforceable, this does not affect the validity of the remaining provisions.
- The Seller and Customer should, where reasonably possible, attempt to resolve complaints or disputes amicably.
- These Terms and Conditions enter into force on the date indicated at the beginning of the document.
